How To React To Being Arrested For A Domestic Violence Charge

Domestic violence, which refers to any type or argument or altercation between family members, is a serious problem in the U.S. Domestic violence can happen between spouses, romantic partners, or people who are related by blood or marriage. If you're charged with a domestic violence offense, it is important to take the matter very seriously-- a domestic violence conviction can have long-lasting repercussions. Take the following steps after being arrested for a domestic violence arrest:

Abstain From Talking

When the police arrive for a domestic violence call, they will likely try to ask many questions about the situation and what happened. It is important to note that you are not obligated to provide a statement, nor should you do so. Anything you say can, and most likely will be used against you in court, so it is in your best interest to stay quiet. All you need to do is provide the police with identification that serves as proof of identity.

Be Polite

One of the worst things you can do after the police arrive at your home for a domestic violence call is to be belligerent or argue with the police officers. Doing so can result in additional charges, and your behavior at the time of arrest will be noted when you go to trial. After the police arrive, it is a good idea to remain as calm as possible and resist arguing with the officers on the scene.

Be Prepared to Spend a Short Amount of Time in Jail

In most states, police officers are required to arrest a person involved in a domestic violence incidence in order to de-escalate the situation. If there is circumstantial evidence that you are the responsible party for any violence that occurred, you most likely will spend at least a few hours in jail until you can see a judge. Being taken to jail does not mean that you are guilty or that you will be convicted of the charge.

Hire an Attorney

If you are charged with a domestic violence offense, is is incredibly important to immediately hire an attorney who specializes in these types of cases. An attorney will know how to build your defense, prepare you for court, and communicate with the prosecutors trying the case. In many cases, an experienced criminal law attorney can secure a favorable plea deal that results in a lesser charge that doesn't include domestic violence, or can help get you acquitted if you go to trial.
